Welcome to the Visit Bonaire mobile application (“the App”), a product of Blue Innovation BV, established in Zwaanshoek, The Netherlands (“we”, “us”, or “the Company”).
By downloading, installing, or using the App, you (“the User”) agree to these Terms and Conditions. If you do not agree, you must immediately discontinue use of the App.
Right of Use: We grant you a limited, non-exclusive, non-transferable license to download and use the App for personal, non-commercial purposes.
Restrictions: You may not:
Copy, distribute, sell, or rent the content (routes, audio, text, photos).
Reverse engineer or decompile the App’s source code.
Use the App in any way that could damage the Company’s servers or networks.
Purchases: The App offers digital products (such as “Premium Tours”) via In-App Purchases (Apple App Store & Google Play Store).
Processing: Payments and billing are handled entirely through the Apple or Google platforms. The terms and conditions of the respective App Store apply to these transactions.
Pricing: All prices include VAT unless stated otherwise. We reserve the right to change prices at any time.
Redemption: If you purchased an access code (voucher) through a third party (such as GetYourGuide, Viator, or our website), you can redeem it within the App to unlock content.
Validity: A code is strictly personal and for one-time use only. Upon activation, the content is linked to your installation or account.
Issues: For issues with a code purchased via a third party, please contact the selling platform primarily for refunds or support.
Notice: For the purchase of digital content (such as tours) within the App:
You consent to the immediate delivery of the digital content.
You acknowledge that you thereby waive your right of withdrawal (14-day cooling-off period) once the download or access has started.
Refund requests for In-App Purchases must be submitted directly to Apple or Google, in accordance with their refund policies.
Software Liability: We do not guarantee that the App will function error-free or uninterrupted at all times. We are not liable for damages resulting from technical failures, GPS inaccuracies, or data loss.
Physical Safety (Reference to Waiver): Using navigation features and following routes is entirely at your own risk. You must obey local traffic laws and account for changing road conditions at all times. For bodily injury and property damage, we refer to our “Release of Liability & Assumption of Risk” statement, which you must accept separately within the App.
Limitation: Our total liability is in all cases limited to the amount you actually paid for the App or the specific tour.
All intellectual property rights regarding the App and its content (including but not limited to brand names, logos, texts, audio guides, and software) belong to the Company or its licensors.
We reserve the right to terminate your access to the App or delete your account if you violate these terms, without any right to a refund.
These terms are exclusively governed by the laws of The Netherlands. Disputes will be submitted to the competent court in The Netherlands.
